Most theories and hypotheses in psychology are verbal in nature, yet their evaluation overwhelmingly relies on inferential statistical procedures. The validity of the move from qualitative to quantitative analysis depends on the verbal and statistical expressions of a hypothesis being closely aligned – that is, that the two must refer to roughly the same set of hypothetical observations. Here, I argue that many applications of statistical inference in psychology fail to meet this basic condition. Focusing on the most widely used (...) class of model in psychology – the linear mixed model – I explore the consequences of failing to statistically operationalize verbal hypotheses in a way that respects researchers' actual generalization intentions. I demonstrate that although the “random effect” formalism is used pervasively in psychology to model intersubject variability, few researchers accord the same treatment to other variables they clearly intend to generalize over. The under-specification of random effects imposes far stronger constraints on the generalizability of results than most researchers appreciate. Ignoring these constraints can dramatically inflate false-positive rates, and often leads researchers to draw sweeping verbal generalizations that lack a meaningful connection to the statistical quantities they are putatively based on. I argue that failure to take the alignment between verbal and statistical expressions seriously lies at the heart of many of psychology's ongoing problems, and conclude with a discussion of several potential avenues for improvement. Panmicropsychism is the view that the fundamental physical ingredients of our universe are also its fundamental phenomenal ingredients. Since there is only a limited number of fundamental physical ingredients, panmicropsychism seems to imply that there exists only a small set (palette) of basic phenomenal qualities. How does this limited palette of basic phenomenal qualities give rise to our rich set of experiences? This is known as ‘the palette problem’. One class of solutions to this problem, large-palette solutions, simply denies that (...) the palette is limited. These solutions assume that all types of phenomenal qualities (color, sound, odor, taste, etc., and presumably also types not experienced by humans) were created fully formed at the birth of our universe. On this view, brains evoke conscious experiences by sampling primordial, preexisting phenomenal spaces. My main claim in this paper is that, by analogy with the mathematical description of the fundamental physical ingredients of our universe, which exhibits simplicity, symmetry, and beauty, panmicropsychists should expect the mathematical description of the fundamental phenomenal ingredients of our universe to exhibit similar features. The goal of this paper is to exemplify this claim using what is arguably the simplest of all types of phenomenal qualities—color. Specifically, I utilize phenomenological data on color to construct the maximally symmetric mathematical description of phenomenal color space. I then show that this mathematical description is isomorphic to the mathematical description of two-state quantum systems in a mixed state. Based on this isomorphism, I suggest that color may be the phenomenal dual aspect of two-state quantum systems. (shrink)

We are currently witnessing a sharp rise in the use of algorithmic decision-making tools. In these instances, a new wave of policy concerns is set forth. This article strives to map out these issues, separating the wheat from the chaff. It aims to provide policy makers and scholars with a comprehensive framework for approaching these thorny issues in their various capacities. To achieve this objective, this article focuses its attention on a general analytical framework, which will be applied to a (...) specific subset of the overall discussion. The analytical framework will reduce the discussion to two dimensions, every one of which addressing two central elements. These four factors call for a distinct discussion, which is at times absent in the existing literature. The two dimensions are the specific and novel problems the process assumedly generates and the specific attributes which exacerbate them. While the problems are articulated in a variety of ways, they most likely could be reduced to two broad categories: efficiency and fairness-based concerns. In the context of this discussion, such problems are usually linked to two salient attributes the algorithmic processes feature—its opaque and automated nature. (shrink)

The presence of gene–environment statistical interaction and correlation in biological development has led both practitioners and philosophers of science to question the legitimacy of heritability estimates. The paper offers a novel approach to assess the impact of GxE and rGE on the way genetic and environmental causation can be partitioned. A probabilistic framework is developed, based on a quantitative genetic model that incorporates GxE and rGE, offering a rigorous way of interpreting heritability estimates. Specifically, given an estimate of heritability and (...) the variance components associated with estimates of GxE and rGE, I arrive at a probabilistic account of the relative effect of genes and environment. Kant's category of reality is an often overlooked element of his Critique of Pure Reason. Tal Glezer shows that it nevertheless belongs at the core of Kant's mature critical philosophy: it captures an issue that motivated his critical turn, shaped his theory of causation, and established the role of his philosophy of science. Glezer's study traces the roots of Kant's category of reality to early modern debates over the intelligibility of substantial forms, fueled by the tension between the idea of (...) non-extended substances and that of extended objects. This tension influenced Kant's pre-critical work, and eventually inspired his radical break towards transcendental idealism. Glezer explores the importance of reality for Kant's conceptions of cause and force, and sheds new light on his philosophy of physical science, including gravity. His book will interest scholars of Kant and of early modern philosophy, as well as historians of scientific ideas. (shrink)

The outbreak of the COVID-19 pandemic in 2020 threw the world into an unexpected turmoil; schools were closed, exams cancelled, and educational systems were forced to react to deep and unexpected changes. In educational policy, however, the idea that we should prepare for an unknown, uncontrollable and risky future has been widely accepted long before the outbreak. Building on insights from complexity theory and the study of dynamic systems, the article critically examines how the standard educational response to future unpredictability, (...) which focuses on enhancing adaptability, fares in a time of crisis. It is argued that the emphasis on adaptability in response to a world that is increasingly becoming volatile, uncertain, complex and ambiguous is often uncritically embraced in educational policy. We suggest that furthering adaptability through education could be suited for tackling everyday uncertainty, yet is an ill-suited response to crisis situations because it hinders transformative change. The article also points to some additional difficulties with striving to further adaptability. Instead, it is argued that developing a vision might prove to be instrumental in guiding an adequate educational response. It is acknowledged that relying on a vision might raise some difficulties, but it is maintained that these can be, at least partially, avoided. (shrink)

The years following Israel’s founding were formative ones for the development of philosophy as an academic discipline in this country. During this period, the distinction between philosophy seen as contiguous with the humanities and social sciences, and philosophy seen as adjacent to the natural and exact sciences began to make its presence felt in the Hebrew University of Jerusalem. This distinction, which was manifest in the curriculum, was by no means unique to the Hebrew University, but reflected the broader bifurcation (...) between two schools of Western philosophy in the twentieth century. In English-speaking countries, it is generally referred to as the divide between analytic and continental philosophy. What was special about the situation at the Hebrew University, however, was that the split manifested itself in a rather small department, being embodied, basically, in one prominent representative of each school – Nathan Rotenstreich and Yehoshua Bar-Hillel. This article will focus on some key aspects of the lives and thought of Rotenstreich and Bar-Hillel. It will address their philosophical maturation as S.H. Bergmann’s students, their views on the goals of twentieth-century philosophy, on the philosopher’s role in public life, and the circumstances under which they started teaching in Jerusalem right after the founding of the State of Israel. Over the last two decades, complexity theory, which is designed to deal with systems of multiple interdependent variables, has been increasingly applied to analyse and shed light on various aspects of education. So far, however, complexity theory has rarely been used, if at all, to examine questions related to educational justice. This article offers a theoretical examination of some possible links between complexity theory and distributive justice in education. It asks how accepting the premise that education is a complex dynamic (...) system should shape the way distributive justice in education is conceptualized and approached. It is argued that complexity theory challenges many assumptions on which the dominant approach for dealing with distributive justice in education rests. The article focuses on three subjects that stem from complexity theory but have implications for dealing with distributive justice in education: system diversity, reductionism, and change. Each of these subjects is examined separately, and some possible contributions of complexity theory to illuminating these subjects in relation to distributive justice in education are discussed. The article ends with a brief illustration of where a complexity-based approach to educational justice leads that focuses on school choice and contrasts it with Brighouse's views on this issue. The disambiguation of a syntactically ambiguous sentence in favor of a less preferred parse can lead to slower reading at the disambiguation point. This phenomenon, referred to as a garden‐path effect, has motivated models in which readers initially maintain only a subset of the possible parses of the sentence, and subsequently require time‐consuming reanalysis to reconstruct a discarded parse. A more recent proposal argues that the garden‐path effect can be reduced to surprisal arising in a fully parallel parser: words consistent (...) with the initially dispreferred but ultimately correct parse are simply less predictable than those consistent with the incorrect parse. Since predictability has pervasive effects in reading far beyond garden‐path sentences, this account, which dispenses with reanalysis mechanisms, is more parsimonious. Crucially, it predicts a linear effect of surprisal: the garden‐path effect is expected to be proportional to the difference in word surprisal between the ultimately correct and ultimately incorrect interpretations. To test this prediction, we used recurrent neural network language models to estimate word‐by‐word surprisal for three temporarily ambiguous constructions. We then estimated the slowdown attributed to each bit of surprisal from human self‐paced reading times, and used that quantity to predict syntactic disambiguation difficulty. Surprisal successfully predicted the existence of garden‐path effects, but drastically underpredicted their magnitude, and failed to predict their relative severity across constructions. We conclude that a full explanation of syntactic disambiguation difficulty may require recovery mechanisms beyond predictability. (shrink)

Spina bifida is a neurodevelopmental disorder that results in a broad range of disability. Over the last few decades, there have been significant advances in diagnosis and treatment of this condition, which have raised concerns regarding how clinicians prognosticate the extent of disability, determine quality of life, and use that information to make treatment recommendations. From the selective treatment of neonates in the 1970s, to the advent of maternal–fetal surgery today, the issues that have been raised surrounding spina bifida intervention (...) invoke principles of medical bioethics such as beneficence and nonmaleficence, while also highlighting how quality of life judgments may drive care decisions. Such changes in treatment norms are also illustrative of how disability is viewed both within the medical community and by society at large. An examination of the changes in spina bifida treatment provides a model through which to understand how ethically complex decisions regarding care for children with disabilities has evolved, and the challenges faced when medical information is combined with value-based judgments to guide medical decision making. In light of the widespread use of algorithmic (intelligent) systems across numerous domains, there is an increasing awareness about the need to explain their underlying decision-making process and resulting outcomes. Since oftentimes these systems are being considered as black boxes, adding explanations to their outcomes may contribute to the perception of their transparency and, as a result, increase users’ trust and fairness perception towards the system, regardless of its actual fairness, which can be measured using various fairness tests and measurements. (...) Different explanation styles may have a different impact on users’ perception of fairness towards the system and on their understanding of the outcome of the system. Hence, there is a need to understand how various explanation styles may impact non-expert users’ perceptions of fairness and understanding of the system’s outcome. In this study we aimed at fulfilling this need. We performed a between-subject user study in order to examine the effect of various explanation styles on users’ fairness perception and understanding of the outcome. In the experiment we examined four known styles of textual explanations (case-based, demographic-based, input influence-based and sensitivity-based) along with a new style (certification-based) that reflect the results of an auditing process of the system. The results suggest that providing some kind of explanation contributes to users’ understanding of the outcome and that some explanation styles are more beneficial than others. Moreover, while explanations provided by the system are important and can indeed enhance users’ perception of fairness, their perception mainly depends on the outcome of the system. The results may shed light on one of the main problems in explainability of algorithmic systems, which is choosing the best explanation to promote users’ fairness perception towards a particular system, with respect to the outcome of the system. The contribution of this study is reflected in the new and realistic case study that was examined, in the creation and evaluation of a new explanation style that can be used as the link between the actual (computational) fairness of the system and users’ fairness perception and in the need of analyzing and evaluating explanations while taking into account the outcome of the system. This study explored pedestrians’ understanding of Fully Autonomous Vehicles intention to stop and what influences pedestrians’ decision to cross the road over time, i.e., learnability. Twenty participants saw fixed simulated urban road crossing scenes with a single FAV on the road as if they were pedestrians intending to cross. Scenes differed from one another in the FAV’s, distance from the crossing place, its physical size, and external Human-Machine Interfaces message by background color, message type, and presentation modality. Eye-tracking data and (...) decision measurements were collected. Results revealed that pedestrians tend to look at the e-HMI before making their decision. However, they did not necessarily decide according to the e-HMIs’ color or message type. Moreover, when they complied with the e-HMI proposition, they tended to hesitate before making the decision. Overall, a learning effect over time was observed in all conditions regardless of e- HMI features and crossing context. Findings suggest that pedestrians’ decision making depends on a combination of the e-HMI implementation and the car distance. Moreover, since the learning curve exists in all conditions and has the same proportion, it is critical to design an interaction that would encourage higher probability of compatible decisions from the first phase. However, to extend all these findings, it is necessary to further examine dynamic situations. (shrink)

Objective performance measures are vastly used in sport psychology despite their inherent limitations (e.g., unaccounted baseline differences). Founded on the nature of group goals in team sports, we aimed at developing the Perceived Performance in Team Sports Questionnaire (PPTSQ) to capture the team members’ perception of their team’s performance. Accordingly, three dimensions were hypothesized:effort investment, skills execution, andperceived outcome. To measure these dimensions, items were generated to address the players’ perception of their team performance as a whole. Four samples of (...) athletes were used to test the psychometric properties of the PPTSQ: professional (n= 231), collegiate (n= 222), professional—retest (n= 89), and mixed professional–collegiate (n= 139). Exploratory and confirmatory factor analyses were used to estimate construct and content validities. These procedures revealed a better data fit to a two-dimensional model that consists of effort investment and perceived outcome. The reliability analyses for the PPTSQ provide satisfactory evidence that the questionnaire is a reliable measure of perceived performance in team sport. Adequate internal consistency emerged for both dimensions (0.75 < ω < 0.89). Furthermore, a high correlation was obtained for temporal stability. Concurrent validity was addressed by correlating the PPTSQ scores with the Group Environment Questionnaire and the Team Assessment Diagnostic Instrument. Correlational analysis between the PPTSQ and an objective measure of performance was used to test its predictive validity. The correlations strongly support the concurrent and predictive validities of the PPTSQ. We conclude that our perceived performance questionnaire can address various objective measures shortcomings (e.g., considering base-rate biases) resulting in a more meaningful team performance metric. Implication of the PPTSQ for sport psychology research and applied work enhancement are discussed in detail. (shrink)

The Sphere Model of Consciousness (SMC) delineates a sphere-shaped matrix that aims to describe the phenomenology of experience using geometric coordinates. According to SMC, an experience of overcoming of the habitual self and the conditioning of memories could be placed at the center of the matrix, which can be then called the Place of Pre-Existence (PPE). The PPE is causally associated with self-determination. In this context, we suggest that silence could be considered as an intentional state enabling self-perception to be (...) focused on the “here and now,” which in turn improves perception of one’s own body in space. To investigate these hypotheses grounded in the model, the current preliminary study examined the Place of Pre-Existence Technique (PPEt), in which practitioners are guided to focus on a self-defined aim; reach a state of detachment from the habitual self; envision the future. 481 volunteers PPEt practitioners completed self-report questionnaires before and after an intensive 3-day meditative training. We analyzed the possibly relationship between subjective experiences related to physical, emotional, mental, temporal, and spatial aspects, as well as self-determination and silence, before and after training. The results indicated a shift from a prevailing influence of mental dimension on the other aspects of experience, to a prevailing influence of spatial dimension. Silence was reported more often following the training, and predominantly related to the mental and emotional experiences. The results are discussed in relation to the shift from Narrative to Minimal Self and to increased balance among the considered dimensions. (shrink)

Baumard's perspective asserts that “opportunity is the mother of innovation,” in contrast to the adage ascribing this role to necessity. Drawing on behavioral ecology and cognition, we propose that both extremes – affluence and scarcity – can drive innovation. We suggest that the types of innovations at these two extremes differ and that both rely on mechanisms operating on different time scales.

This article presents a critical discursive analysis around the concept of menstrual health in a series of texts published in book format and in social networks in the last five years (2019-2023) by different activists and menstrual educators in Argentina. In a reading itinerary that goes from the singular to the collective, I identify the configuration of an experiential episteme that redefines the menstruating body as informational and multidimensional, which enables that, in addition to a physiological dimension, its role in (...) different social, political, cultural, environmental and economic contexts is vindicated. I place these examples in the context of the neoliberal precariousness that installs the therapeutic-managerial culture as a moral imperative, while at the same time it challenges certain subjectivities with relative privilege —white, urban, trained and educated women— to dispute and strain meanings. This paper provides an account of the nature of creativity in high-energy physics experiments through an integrated historical and philosophical study of the current and planned attempts to measure the self-coupling of the Higgs boson by two experimental collaborations at the Large Hadron Collider and the planned High Luminosity Large Hadron Collider. A notion of creativity is first identified broadly as an increase in the epistemic value of a measurement outcome from an unexpected transformation, and narrowly as a condition for (...) knowledge of the measurement of the self-coupling of the Higgs. Drawing upon Tal’s model-based epistemology of measurement this paper shows how without change to ‘readings’ a transformation to the model of the measurement process can increase the epistemic value of the measurement outcome. Such transformations are attributed to the creativity of the experimental collaboration. Creativity, in this context, is both a product, a creative and improved model, and the distributed collaborative process of transformation to the model of the measurement process. For the case of the planned measurements at the HL-LHC, where models of the measurement process perform the epistemic function of prediction, creativity is included in the models of the measurement process, both as projected quantified creativity and as an assumed property of the future collaborations. Husserl, as is well known, bases his study of appearing on subjective functions. He also makes appearing prior to being insofar phenomenology grants being to entities only to the point that they can appear. Both positions result in the paradox that he presents in the Crisis, where he asks: “How can human subjectivity, which is a part of the world, constitute the whole world, i.e., constitute it as its intentional product…? The subjective part of the world swallows up, so to (...) speak, the whole world including itself. What an absurdity!”. The paradox arises from Husserl’s taking being as presence and asserting that presence is established through constitution and, as such, is the work of subjectivity. In this article, I explore an alternative based on Aristotle's concept of functioning. This is a functioning that is prior to both subjects and objects, a functioning that is responsible for both being and appearing. The introduction of this concept, I argue, does not change Husserl’s description of the functioning of constitution. It does, however, add an ontological basis that prevents phenomenology from falling into this paradox.Husserl, como es bien sabido, basa su estudio del aparecer en funciones sujetivas. También presenta el aparecer como anterior al ser en tanto en cuanto la fenomenología le concede ser a las entidades sólo hasta el punto de que puedan aparecer. Ambas posiciones dan como resultado la paradoja que presenta en La crisis, donde pregunta: "¿Cómo puede la subjetividad humana, que es parte del mundo, constituir el mundo entero, es decir, constituirlo como su producto intencional...? La parte subjetiva del mundo se traga, por así decirlo, todo el mundo, incluido él mismo. ¡Qué absurdo!". La paradoja surge del hecho de que Husserl toma el ser como presencia y de que afirma que la presencia se establece a través de la constitución y que, como tal, es el trabajo de la subjetividad. En este artículo, exploro una alternativa basada en el concepto de funcionamiento de Aristóteles. Este es un funcionamiento que es anterior a ambos sujetos y objetos, un funcionamiento que es responsable de ser y aparecer. La introducción de este concepto, sostengo, no cambia la des-cripción de Husserl del funcionamiento de la constitución. Sin embargo, agrega una base ontológica que evita que la fenomenología caiga en esta paradoja. (shrink)

Aceita a provocação de pensar o presente e, como tal, alia-se aos pensamentos de Michel Foucault, tentando refletir, ética e politicamente, desconfiando de todos os projetos políticos voltados ao pretenso bem comum. Segundo o filósofo francês, vivemos agora, mais do que antes, no interior de uma combinação complexa de técnicas de individuação e processos totalizantes, que mascaram as relações de poder. O (...) estudo será organizado com a abordagem inicial do papel da disciplina e da norma; em seguida, serão desenvolvidos os conceitos de governamentalidade, sujeito e poder e relações de biopoder imbricadas em situações ético-políticas. Logo após, serão apresentadas algumas alternativas denominadas de lutas transversais, como possibilidades de construção de novas subjetividades, que serão incorporadas, neste estudo, como possíveis formas de aproveitamento no sistema escolar. Dentro del período se estudian las opiniones que, como respuestas, aparecieron ante los artículos de Ortega y Gasset referidos "al hombre a la defensiva" y a "la pampa, promesas"; la discusión sobre el rol de los intelectuales; los interrogantes sobre una supuesta "nueva generación"; las tipologías (...) de un imaginario "ser argentino"; el vínculo entre arte y política, como la función del deporte. Igualmente el artículo recoge las reflexiones suscitadas por las diferentes encuestas lanzadas por la Revista; el suicidio de Lugones, y aquellos aspectos que nos acercan a miradas en busca de un sí mismos, donde los protagonistas se debatían en la encrucijada intelectual y política, tal como aparecieron en esta emblemática publicación. ENGLISH: This article analyses the Journal Nosotros (1907-1943) during the 1930's. The main focus of the research is to identify the contributions by national authors that questioned the Argentinean identity. In particular, this study explores the opinions that were published in response to articles from Ortega y Gasset about "el hombre a la defensiva" and "la pampa, promesas"; discussions on the role of intellectuals; inquiries about a supposed "new generation"; the typologies of an imaginary "Argentinean being"; the links between art and politics; and the role of sports. The article also discusses the ideas raised by different surveys launched by the Journal; the suicide of Lugones, and views on the search of the self, in which the protagonists debated the intellectual and political crossroads that were presented by Nosotros. Este estudio busca rescatar el papel del pensamiento antropológico criminal en Chile en la construcción de una nueva imagen del criminal urbano. En tal sentido, se argumenta que las ideas de Lombroso y Bertillón habrían otorgado un respaldo “científico” a prejuicios que estigmatizaban a grupos específicos de la población en las ciudades, como eran los sectores populares. Igualmente, en un período cronológico que abarca desde fines del siglo XIX hasta mediados de la centuria siguiente se puede apreciar cómo los planteamientos (...) centrales de este nuevo saber criminológico habrían ayudado a justificar los criterios y medidas de las autoridades, tendientes a definir una política de defensa social basada en la caracterización de un “enemigo común”, identificable ahora a partir de un registro fotográfico que retrataba asimismo su malsana naturaleza interior, como también por determinados rasgos físicos que revelaban su predisposición biológica al mal. This study seeks to analyze the role of the anthropological depiction of crime in Chile for the construction of a new image of the urban criminal. Accordingly, it is argued that notions of Bertillon and Lombroso would have given “scientific” support to prejudices that stigmatized specific population groups in the popular sectors of the cities. Also, in a chronological period from the end of the 19th century until the middle of the next century, we can see how the main ideas of this new criminological approaches would have helped to justify the criteria and measures taken by the authorities to define a social defense policy based on the characterization of a “common enemy”. This was now identifiable from a photographic record that depicted his unhealthy inner nature, as well as certain physical features that revealed his biological predisposition to evil. (shrink)

Se expone la continuidad de esta noción desde John Locke a John Rawls, destacando su vínculo con la religiosidad doctrinalmente minimalista de la tradición erasmista. Se cuestiona que, dado tal vínculo, esta ida pueda servir de criterio para evaluar la presencia de otras voces religiosas en la vida pública. The article addresses the idea of public reason, treating in particular its concomitant ideal of reasonableness. (...) It exposes the continuity of this notion from John Locke to John Rawls, highlighting its connection to the minimalist doctrinal religiosity of the Erasmist tradition. Este texto se propõe perspectivar a agência humana no entorno do ato de grafar, ou seja, trata das relações e suas tensões entre as percepções do real e de sua inscrição no tempo-espaço, com ênfase à escrita. Dimensiona essa questão circunscrevendo certa noção de um corpo em jogo no mundo, no qual nota e anota o que percebe, via uma Poética da Notação Esquizográfica. Passa, por conseguinte, a perspectivar tal noção de corpo a partir da ideia de um indivíduo que, (...) em Deleuze, é colocada em questão nos termos de um eu passível, ou um ante-eu, como condição para determinações diferenciais dos e nos encontros: sob esse ante-eu, todavia, se impõe um Eu pessoal. Um corpo é, então, considerado como composto por singularidades em movimentos contínuos, variações nas quais irrompem individuações – individualidades dotadas de forças pré-individuais inerentes aos corpos. O problema é colocado a partir da ideia, presente em Barthes, de que uma logosfera nos envolve, e que precisamos, portanto, sacudi-la, pois se trata de um dado do nosso sujeito centrado: pôr em jogo, assim, o que, em nossa individualidade, constitui o Eu pessoal, que condiciona os movimentos da representação, via recognição. Com efeito, é um jogo com a linguagem, tomando-a, com Deleuze e Guattari, como incorpóreos que se expressam dos corpos. Trata-se de ponderar que o mundo, após pensado, só pode ser perspectivado nesses termos, com o pensamento e a linguagem. Destarte, o jogo que propomos – e seus efeitos sobre a educação –é condicionado, com Baudrillard, por uma impostura radical, que passa a lidar com o real, via certa Poética da Notação Esquizográfica. O artigo tem por objeto o exame de três registros de gritantes e distintos paradoxos na Doutrina do Direito de Kant. Registros feitos em tempos e contextos históricos diferentes por Friedrich Bouterwek, Marcus Willaschek e Balthazar Barbosa Filho. Bouterwek atribuiu a Kant a mais paradoxal das proposições jamais enunciadas por qualquer autor, a de que a mera ideia de soberania deve obrigar-nos a obedecer como a nosso inquestionável senhor a quem quer que se haja estabelecido como tal, sem que caiba (...) indagar quem lhe deu o direito de comandar-nos. Willaschek aponta a incompatibilidade de duas teses centrais da doutrina kantiana: a do caráter externo dos vínculos jurídicos e a da incondicionalidade obrigacional do direito positivo, pois não é possível entender como é possível termo-nos como obrigados por imperativos jurídicos e, ao mesmo, vermo-nos internamente isentados do dever de obedecê-los. O ponto crítico de Balthazar é alegar que não pode haver na filosofia kantiana uma crítica da razão político e jurídica, simplesmente porque o conceito de imputação, base da normatividade própria dessas esferas, pressupõe uma pluralidade de agentes livres que, justamente, só pode ser uma pressuposição, pois nosso acesso à normatividade prática só pode ter lugar em primeira pessoa. No exame a que o artigo submete essas alegações, o artigo argumenta, em objeção à tese de Balthazar, que o caráter universal e categórico da força que vincula o sujeito quando confrontado com a lei moral em primeira pessoa necessariamente se desvaneceria se, ao mesmo tempo, ele não fosse tomado pela evidência de que a realidade objetiva dos princípios morais é não só instanciável, mas assegurada pela múltipla instanciação. Com relação às dificuldades levantadas por Willaschek e Bouterwek, o artigo argumenta que o princípio exeundum e statu naturali, enquanto norma metapositiva, anterior à divisão do domínio prático entre doutrina do direito e doutrina da virtude, permite ao mesmo tempo compreender a exigência de obediência ao poder constituído e a restrição das obrigações jurídico-políticas exclusivamente ao foro externo.AbstractThe object of the article is to examine three claims about three distinct and allegedly blatant paradoxes in Kant's Doctrine of Right. These three critical points had been made in distinct times and contexts by Friedrich Bouterwek, Marcus Willaschek e Balthazar Barbosa Filho. Bouterwek attributed to Kant the most paradoxical of all paradoxical propositions, the statement that by the mere idea of sovereignty we are obliged to obey as our lord who has imposed himself upon us, without questioning from where he got such right. Willaschek points out the incompatibility of two main theses of Kantian doctrine of right: the claims that the legal bounds are of external character and that they are the source of unconditional obligations, since it seems impossible to understand how it would be possible to be obliged by juridical norms and decisions and at the same time to be exempted of the internal duty of compliance. The radical objection of Professor Balthazar is the claim that in the context of Kantian Philosophy it is impossible to admit a critique of the juridical and political reason because the concept of imputation, ground of the normativity in these domains, requires not only the presupposition of free agents, but a true and secure epistemic access to them, which is, according to him, impossible considering that the moral law and the other practical principles are accessible for us only in the first person. In the course of the appraisal of such claims, the article contest that objection arguing that the universal and categorical force of the normative bound experienced by the subject when confronted with the moral law in the first person would ineluctably vanish if, at the same time, he had not been taken by the evidence that the objective reality of the moral principles is secured by multiple instancing. Regarding the difficulties raised by Willaschek and Bouterwek, the article argues that the principle exeundum e statu naturali, as a norm of meta-positive character, prior to the division of practical domains between the doctrine of right and the doctrine of virtue, is the cue both to the understanding of the requirement of unquestioning obedience to the constituted power and to the restriction of the validity of this requirement only in foro externo. A filosofia alemã do século XIX posterior a Hegel está bastante estudada em três direções. A primeira, que surge da luta entre hegelianos de esquerda e direita, acaba por conduzir ao materialismo e ao marxismo; a segunda, que se expressa na vertente irracionalista e anti-sistemática, passa por Schopenhauer, Kierkegaard e Nietzsche; a terceira é constituída pelo neo-kantismo e suas derivações, cuja versão oficial teria suas raízes fincadas pelo famoso discurso inaugural de Zeller e pelo livro de Otto Liebmann, que deram (...) o impulso ao movimento “Zurück zu Kant”. Em tal visão de conjunto, o grande ausente é um movimento contínuo, ainda quando irregular e multifacetado, que terminará conduzindo à filosofia contemporânea. Este movimento tem em Trendelenburg uma figura chave. É com suas “Investigações Lógicas” que se inicia a reformulação das relações entre filosofia e ciência e, neste sentido, o verdadeiro retorno a Kant. O fato de sua obra principal ter exatamente o mesmo nome que a coleção de ensaios temáticos de Frege, a obra de ruptura de Husserl e as dissertações de doutorado de Cohen, Dilthey e Brentano significa algo mais que curiosas coincidências. “Zurück zu Kant” (Adolf Trendelenburg the overcoming of idealism and the roots of contemporary philosophy) Abstract Considering history of philosophy as a whole, the two main traditions of thought from the 20th century (analytic and phenomenological-hermeneutic) can be regarded as being variants of one same fundamental turn. This systematic relation is connected to a common historical root. To highlight it implies to review the ideas that are deeply in the basis of the historiography of the German thought in the 19th century. Beyond names, problems and theses that may appear to have at first sight no relationship whatsoever, we can notice a continuous unitary development that has not yet received all the attention it deserves. In this movement, Adolf Trendelenburg stands out, once the beginners of both the abovementioned traditions and of neokantianism (Frege, Brentano, Dilthey and Cohen) received a decisive impulse from his reflections. Certamente, desde que o ser humano existe, a vida nunca esteve isenta de manipulação técnica. Todavia, formas recentes de biotecnologia vão mais longe, tendendo a tornar indiscernível as distinções clássicas entre crescimento natural e produção artificial. Ars sive natura, este poderia ser o novo slogan. Neste sentido, em oposição à bioética corrente que tenta compensar o monismo tecnológico através de um dualismo prático, discutiremos a idéia de que, quando age sobre o Outro (Fremdeneinwirkung), a biotecnologia nunca é puramente técnica, sendo (...) imediatamente prática, ética e política. Por outro lado, confrontada com novos desafios tecnológicos, a fenomenologia necessita assumir certas características de fenomenotecnologia; ações não são nunca meramente práticas. Uma tal combinação entre fenomenologia e fenomenotecnologia abre especiais perspectivas no que diz respeito ao trato da questão da vida humana. Primeiramente, descreveremos o eu corporal como gerador de sua própria história, na medida que evidencia graus de identidade e se constitui como altamente vulnerável. Em segundo lugar, distinguiremos entre a atitude técnica, restrita ao fato de que algo se modifica, e a atitude terapêutica, que se dirige a alguém que sofre: o paciente. A seguir, ultrapassaremos os limites do enquadramento clínico ao considerar novas conquistas no que diz respeito à produção da vida (por exemplo, clonagem e manipulação genética). Antes de simplesmente argumentar pró ou contra, temos de indagar o que significa produzir um eu vivo. Neste contexto, o tempo da poiesis será contrastado com o do pathos. Examinaremos o lugar desde o qual um ser vivo ou pessoal pode ser definido como alguém em si, e pretendemos tencionar simultaneamente o caráter paradoxal de atribuição de um eu ao Outro (Fremdezuschreibung), que assemelha-se ao paradoxo de ter a experiência do Outro como Outro (Fremderfahrung). Pois a pré-história e a pós-história de um alguém específico, incluindo nascimento e morte, é apenas acessível a nós em termos de substituição. Reduzidos a conjuntos de células, seres humanos seriam liberados de tudo isto. Restaria algo sobre o que falamos, mas de modo algum alguém falando a nós. PALAVRAS-CHAVE – Biotecnologia. Terapia. Fenomenologia. Fenomenotecnologia. ABSTRACT Certainly, as long as human beings exist, life has never been exempt from technical manipulations. However, recent forms of biotechnology go further, tending to blur the classical distinction between natural growth and artificial production. Ars sive natura, that may be the new slogan. Now, in opposition to current bioethics which try to compensate the technological monism by means of a practical dualism, we will argue that by acting upon the Other (Fremdeinwirkung) biotechnology is never purely technical, it is immediately practical, ethical and political. On the other side, faced with new technological challenges, phenomenology needs certain features of phenomenotechnology; actions are never merely practical. Such an intertwining of phenomenology and phenomenotechnology opens up special perspectives in dealing with the issue of human life. Firstly, we will describe the bodily self as generating its own history, as showing grades of selfhood and as being highly vulnerable. Secondly, we will distinguish between the technological attitude, restricted on something to be changed, and the therapeutic attitude, addressed to somebody suffering, namely the patient. In the end, we cross the limits of the clinical frame by considering new attempts of life production (e.g. cloning and gene manipulation). Before simply arguing pro and con we have to ask what does it mean to produce a living self. In this context the time of poiesis will be contrasted with the time of pathos. We will examine the place from where a living or personal being may be defined as somebody in itself, and we will simultaneously stress the paradoxical character of ascribing the status of a self to the Other (Fremdzuschreibung), which resembles the paradox of experiencing the Other as an Other (Fremderfahrung). At last, the pre-history and the post-history of a oneself, including birth and death, is only accessible for us by means of substitution. Reduced to cell ensembles, human beings would get rid of all that. There would be left something we speak about, but by no means somebody speaking to us. KEY WORDS – Biotechnology. Therapy. Raymund Schwager SJ suggested a dramatic way of looking at the Christ event, as recorded in the New Testament, in order to clarify the meaning of it and provide a coherent picture. Bernard Lonergan SJ developed a theological methodology for our day. In this article, the author tries to determine how Schwager's approach relates to Lonergan's methodology. He wants to investigate the question: what functional specialty is Schwager engaged in in his main work? The answer shall be that this is (...) foundations. The author of the article proceeds by (1) introducing the most important elements of Schwager's dramatic understanding of the Christ event and (2) of Lonergan's methodology, and then by linking them with one another; (3) he will try to show how Schwager's subdivision of the Christ event into five acts brings out the contours of Jesus' struggle with his opponents as an instance of dialectic in Lonergan's sense; (4) that the Easter experience will be construed as a new, foundational, act that objectifies conversion to human authenticity; and that (5) by discerning all this in the Christ event dramatic theology defines soteriology as the horizon within which Christian doctrines and systematics have to stand and elucidates the way soteriology should be construed; that way dramatic theology determines itself as a foundational enterprise. For the author of the article, this constitutes an exemplary case of the genesis of special theological categories. /// Segundo o artigo, Raymund Schwager SJ propôs um modo dramático de encarar o acontecimento crístico, tal como o mesmo nos é relatado nos textos do Novo Testamento, em ordem a clarificar o seu sentido e a oferecer-nos uma imagem coerente do mesmo. Por seu lado, Bernard Lonergan SJ desenvolveu uma metodologia teológica adequada às exigências do nosso tempo. Assim, o autor do artigo propõe-se determinar de que modo a abordagem de Schwager está relacionada com a metodologia de Lonergan. O seu objectivo é investigar a seguinte questão: qual é a especialidade funcional com que Schwager se compromete na sua principal obra? A resposta será que se trata das fundações. Com isso, o artigo desenvolve-se da seguinte maneira: (1) introdução dos elementos mais importantes na compreensão dramática de Schwager acerca do acontecimento crístico; (2) introdução dos elementos mais importantes da metodologia lonerganiana, para depois os relacionar um ao outro; (3) mostrar de que modo a subdivisão de Schwager do acontecimento crístico em cinco actos é capaz de trazer ao de cima os contornos da luta de Jesus com os seus opositores como uma instância dialéctica no sentido de Lonergan; (4) mostrar de que modo a experiência pascal pode ser construída como um novo, e fundacional, acto que objectiva a conversão à autenticidade humana; (5) mostrar até que ponto mediante o discernimento de tudo isto no acontecimento crístico, a teologia dramática define a soteriologia como o horizonte dentro do qual as doutrinas cristãs e a sistemática teológica têm de se afirmar e elucida o modo como a sotereologia tem de ser construída. Deste modo, a teologia dramática determina-se a si mesma como um empreendimento fundacional. High-level perception--”the process of making sense of complex data at an abstract, conceptual level--”is fundamental to human cognition. Through high-level perception, chaotic environmen- tal stimuli are organized into the mental representations that are used throughout cognitive pro- cessing. Much work in traditional artificial intelligence has ignored the process of high-level perception, by starting with hand-coded representations. In this paper, we argue that this dis- missal of perceptual processes leads to distorted models of human cognition. We examine some existing artificial-intelligence models--”notably (...) BACON, a model of scientific discovery, and the Structure-Mapping Engine, a model of analogical thought--”and argue that these are flawed pre- cisely because they downplay the role of high-level perception. Further, we argue that perceptu- al processes cannot be separated from other cognitive processes even in principle, and therefore that traditional artificial-intelligence models cannot be defended by supposing the existence of a --œrepresentation module--� that supplies representations ready-made. Finally, we describe a model of high-level perception and analogical thought in which perceptual processing is integrated with analogical mapping, leading to the flexible build-up of representations appropriate to a given context. RESUMO O objetivo deste trabalho é indicar como a exploração estilística de Margaret Cavendish responde às particularidades do conceito de natureza dela, por exemplo, a tese de que a natureza é uma matéria viva, infinita, mutável e heterogênea. Primeiramente, mostrarei o modo pelo qual a autora está presente em seus escritos, como ela escreve de uma perspectiva de primeira pessoa sobre sua própria experiência e de quem ela é. Resumirei brevemente sua biografia e o contexto no qual ela praticou filosofia. (...) Dado que suas escolhas de estilo são bastante numerosas, apresentarei somente algumas poucas, entre as peculiaridades estilísticas dela. Em segundo lugar, desenvolverei uma visão geral do seu conceito de natureza, ao contrário do proposto pelas teorias mecanicistas de seu tempo. Esclarecerei que tal conceito é expresso adequadamente pela diversidade estilística à qual Cavendish se volta em suas investigações. ABSTRACT This paper aims at indicating how Margaret Cavendish's stylistic exploration answer to the particularities of her concept of nature, i.e. the thesis that nature is live, infinite, changing and heterogeneous matter. I will first show the way in which the author is present in her writings, as she writes from a first person perspective about her own experience and from who she is. I will briefly summarise her biography and the context in which she practiced philosophy. Given that her stylistic choices are quite numerous, I will only present a few of her stylistic particularities. Secondly, I will develop the general outline of her concept of nature, as opposed to the one proposed by the mechanistic theories of her time. I will make it clear that said concept is adequately expressed in the stylistic diversity to which Cavendish turns in her investigations. (shrink)

In this paper, I argue that even if the Hard Problem of Content, as identified by Hutto and Myin, is important, it was already solved in natu- ralized semantics, and satisfactory solutions to the problem do not rely merely on the notion of information as covariance. I point out that Hutto and Myin have double standards for linguistic and mental representation, which leads to a peculiar inconsistency. Were they to apply the same standards to basic and linguistic minds, they would (...) either have to embrace representationalism or turn to semantic nihilism, which is, as I argue, an unstable and unattractive position. Hence, I conclude, their book does not offer an alternative to representation- alism. At the same time, it reminds us that representational talk in cognitive science cannot be taken for granted and that information is different from men- tal representation. Although this claim is not new, Hutto and Myin defend it forcefully and elegantly. (shrink)

The Polluter Pays Principle (PPP) states that polluters should bear the burdens as- sociated with their pollution. This principle has been highly contested because of the pu- tative impossibility of considering individuals morally responsible for an important amount of their emissions. For the PPP faces the so-called excusable ignorance objec- tion, which states that polluters were for a long time non-negligently ignorant about the negative consequences of greenhouse gas emissions and, thus, cannot be considered morally responsible for their negative consequences. (...) This paper focuses on the concept of moral responsibility as it appears in the excusable ignorance objection. I claim that this objection stems from a narrow notion of moral responsibility and that a more fundamen- tal notion of moral responsibility would pave the way to overcome it. I show that it should be out of the question whether historical polluters should bear some burdens asso- ciated with climate change because of their historical emissions. The relevant question is which kind of burdens they can legitimately be asked to bear. I argue that this notion of moral responsibility allows us to assign burdens of symbolic reparation, which are at the core of ‘Loss and Damage’ policies. (shrink)

This paper is divided in two parts. At first, we show the different roles played by quotations all through Saint Augustin's De Magistro. We compare then the structure in which the text is established to the theory that is developed over there. From such a comparison, we can see that in the mentioned text a theory of language isn't philosophically fundamental and that a dialogue isn't the best way to reach the truth.Este artigo está dividido em duas partes. Primeiro, mostramos (...) os diferentes papéis das citações presentes no De Magistio, de Santo Agostinho. Depois, comparamos a estrutura em que o texto está disposto com a teoria que é aí desenvolvida. A partir de tal comparação, podemos ver que, nesse texto, uma teoria da linguagem não é filosoficamente fundamental e que o diálogo não é a melhor forma de alcançar a verdade. (shrink)

In this paper I deal with the problem of how Husserl can coherently claim that life-world is both (1) the founding presupposition of science and (2) a whole that has science as its part. The approach suggested here is based on Husserl's ideas regarding multi-layered transcenden tal intentional constitution of correlative noemata. In our intentional correlations we experi ence objectities in their appropriate horizons of co-givenness. Both the objectifies and their horizons are multi-layered structures containing a core of primordial, perceptual, (...) pre-thematic givenness and a series of historically, thematically, and scientifically established noematic sedi ments. Nevertheless, we directly experience the at-each-time actual or active constitutive layer. In its constitution, however, the latter comprises also the underlying founding noematic layers that make what is directly given possible. "Life-world", then, means two things: (a) the totality of the actual and possible horizon- and object-givenness, and (b) the core of it, i.e., the pre thematic, simple perceptual, object- and horizon-givenness - with the latter only experience able via the currently prevalent level of the former. Sense (b) supports Husserl's claim (1); sense (a) supports his claim (2). (shrink)

INTRODUCTION BY NANCY FUMERO What is a translation that stalls comprehension? That, when read, parsed, obfuscates comprehension through any language – English, Portuguese. It is inevitable that readers expect fidelity from translations. That language mirror with a sort of precision that enables the reader to become of another location, condition, to grasp in English in a similar vein as readers of Portuguese might from João Guimarães Rosa’s GRANDE SERTÃO: VEREDAS. There is the expectation that translations enable mobility. That what was (...) written in one language be accessible in another. And that a translator is to serve as a mediator, acting ultimately in service to ideas within the source text. To disperse them. However, this notion of translation is partly antithetical to the ideas in Rosa’s work. Or, alternately, to convey the despair of terrain slipping beneath one’s feet, and to encounter the heightened suspense of magic, the translation, as part of its strategy, cannot devotedly rely on its original language, not as its source text. The work undertaken by Felipe W.Martinez is a new form of translation that risks everything in order to encounter the same treacherous knowing Rosa had traversed. And it takes its risks by not taking risks: by being, almost word for word, a literal translation. This is an approach that reductively converts, as opposed to translates. The idiomatic differences between English and Portuguese are not accented. The syntax is not finessed. Liberties are not assumed on account of improving readability. What stands, resoundingly amid such absences, is the awakened challenge of reading. The genuine peril of not knowing. That is, this translation, one that purports to know nothing, creates access into the guileful world Rosa had created in Portuguese. But not by translating. If anything, GRANDE SERTÃO: VEREDAS is speaking a cosmic language through a linguistic one. And W.Martinez does us the service of recognizing this, as what configures the shapes of words and sentences is not as simple as neologisms, portmanteaus, and digressions, but as terrifying as the path the fool traverses: all paths. As such, this translation doesn’t speak English, just as the original does not speak Portuguese. It is the assemblage of paradox as a new logic that can be navigated, if only one could suspend the comfort of readability, of expectation. If one could descend a mountain in the pitch dark of night, each step shocking the body, unable to acclimate to the unleveled heights. Without a doubt, the translation is incongruous to the Portuguese. Taking a small excerpt to compare: Eh, well, thereafter, the rest the Sir provide: comes the bread, comes the hand, comes the god, comes the dog. What is striking is the interplay between “god” and “dog”. To most English speakers, this anagram is a familiar one. But in Portuguese the words god (“deus”) and dog (“cão”) are not so closely linked. In fact, there is no direct mention of “deus” in Rosa’s text: Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Both are fascinating. In Rosa’s excerpt, the rhythm is unmistakable and precise, despite, of course, the indices of hesitation: the commas, the Eh, the uncomfortable way of searching through prolongation and wait. This is the sort of paradox Rosa can engage within a sentence. W.Martinez’s does this as well, at a scale that reverberates beyond the sentence, and with one noticeable addition: deus. What may appear to be an overstep, to add such a weighted word that draws out wordplay but is, nevertheless, not in the source text, is exemplary of risk. The translation buzzes because of it. This is because throughout the text we encounter dogs frequently, as some primal beast on par with humans. The dog is one that masters and can be mastered. A creature that is at times its face, and at others a mask. It is a powerful presence. For the translator to be attuned to the reverent undercurrent attributed to this animal, and create within the translation such charged play in English from what was only an implication in Portuguese, is in tribute to the grand beauty within dissonance. What aberrant modes of writing and translation can teach us most assuredly, is that things, words, are not in states of rightness or wrongness, but of oscillation. This isn’t so different from what Rosa says himself: The Sir look…see: the most important and beautiful, of the world, is this: that the people are not always same, still were not completed — but that they go always shifting. They tune or detune. We find this so readily in W.Martinez’s translation, this tuning and detuning. O ponto de partida do presente artigo consiste na afirmação de que as religiões originárias do Próximo Oriente - Judaísmo, Cristianismo, e Islamismo - contêm em si mesmas inconsistências práticas e teóricas. Mais ainda, o autor afirma que estas religiões estão em contradição umas com as outras no que diz respeito a aspectos teológicos essenciais, para além de que entre elas existe um passado de guerra e de conflito. Ora estas são precisamente as razões pelas quais o autor considera que (...) a credibilidade epistemológica e moral destas religiões foi dramaticamente afectada. Daí o principal objectivo do artigo: contribuir para o esclarecimento do modo como Filosofia e Teologia podem cooperar entre si em ordem a uma mitigação destas deficiências. Nesse sentido, segundo o autor, uma e outra devem abraçar a possibilidade de demonstrar epistemologicamente que os conteúdos da revelação do ponto de vista da razão não são nem demonstráveis nem refutáveis, pois esses conteúdos não são proposições científicas acerca de eventos e processos interiores ao mundo, mas apenas a expressão de uma atitude religiosa em relação ao mundo no seu todo (e em relação a Deus). Nessa medida, diz o autor, nada justifica que atitudes religiosas de fé e de amor sejam caracterizadas como 'irracionais', antes a elas se devendo aplicar a designação de 'a-racional' ou simplesmente de 'transracional. Mais ainda, a Filosofia e a Teologia estão em posição de mostrar de que modo atitudes religiosas fundamentais estão construídas umas sobre as outras. Com efeito, básica em todas as formas de religião é uma atitude em relação ao mundo considerado como um todo, tal como se pode encontrar, por exemplo, no Taoismo ou no Zen-Budismo, de modo que aqui não se encontra qualquer forma de crença numa divindade transcendente; ora é precisamente esta atitude que o autor do artigo designa por 'Religiosidade A'. Como 'Religiosidade B', por outro lado, designa o autor toda a atitude religiosa de fundo que transcende o mundo presente e nos remete para a existência de um Deus único e da sua Revelação, tal como é o caso com o Judaísmo, o Cristianismo, e o Islamismo. Aqui, a tarefa consiste sobretudo em clarificar de forma lógica e conceptual a possibilidade de uma auto-revelação divina bem como da sua aceitabilidade nos termos de uma crença humanamente constituída. Finalmente, o artigo refere também aquela que o autor considera ser a 'Religiosidade C', expressão esta que simplesmente denota aquela atitude em que, com base nas premissas presentes nas formas A e B de religiosidade, somos especificamente remetidos para á Revelação cristã, ou seja, para a experiência nos termos da qual se professa a encarnação de Deus em Jesus de Nazaré e se afirma a sua condição de ser expressão do amor incondicional de Deus para com todos os seres humanos. Na verdade, a natureza incondicional deste amor apresenta-se como um escândalo moral diante da auto-compreensão ética da humanidade. Consequentemente, a incompreensibiliâade deste amor não pode ser senão objecto da revelação divina e da pura fé, únicos modos possíveis de ele se transformar numa possível justificação 'moral' dos seres humanos. /// Starting-point of this article is the fact that the religions originated from the Near East - Judaism, Christianity, and Islam - do contain in themselves theoretical and practical inconsistencies. Moreover, they contradict each other in essential theological regards, and they made war upon each other in the past. For these reasons, their epistemological and moral credibility has been dramatically diminished. In this context, the article aims at showing how philosophy and theology might be able to work together in alleviating these deficits. First, they may demonstrate epistemologically that the contents of revelation are neither rationally demonstrable nor refutable because they are not scientific statements upon events and processes within the world but the expression of a religious attitude towards the world as a whole (and towards God). Therefore, such attitudes as religious faith and love shouldn't be designated 'irrational', but rather as arational' or, 'transrational'. Furthermore, philosophy and theology are able to show in what manner fundamental religious attitudes are built upon another: Basic for all higher forms of religion is an attitude towards the world as a whole – as one can find for instance in Daoism or Zen-Buddhism – where there is not yet any belief in a transcendent deity; that attitude is called 'Religiosity A'. So called 'Religiosity B' is a fundamental attitude which transcends this world and refers to a sole God and his revelation as can be found among Jews, Christians, and Muslims. Here, the possibility of divine self-revelation and of its acceptability by human faith has to be clarified logically and conceptually. Finally, 'Religiosity C denotes that attitude which, on the premises of those Religiosities A and B, refers to the specifically Christian revelation which confesses the incarnation of God in Jesus and presents him as the expression of God's unconditional love to all human beings. The unconditionality of this love seems to be a moral scandal to human moral understanding. Therefore, this unconceivable love has to be object of divine revelation and of pure faith so that it might be the basis of all possible 'moral' justification of humankind. (shrink)

"My argument is as follows. In the first section, I sketch briefly the ways in which intentionalism might provide a solution to the problem of vagueness. The second section describes the different areas in which counterfactuals must be invoked by intentionalism. In the third section I point out that on a classic analysis of counterfactuals - that of David Lewis and Robert Stalnaker - the truth conditions of counterfactuals depend on relations of similarity among possible worlds. Since similarity is vague, (...) so are counterfactuals. Finally, I show that there is no unique solution to the problem of vagueness for the specific types of counterfactuals required by intentionalists - those referring to authors' or legislators' mental states, and those attempting to transport historical authors into the present. Although some counterfactuals are relatively 'insensitive' - in Lewis's sense -- those required in intentionalist interpretation are at least moderately sensitive. This means taht different contexts will resolve the vagueness in different ways. The choice among contexts must be made by the interpreter and is not determined by author's intentions. Hence the vagueness due to counterfactual reasoning about author's intention leads to indeterminacies that cannot be resolved by intentionalism itself. Intentionalism is a solution neither to the problem of vagueness nor to the problem of indeterminacy." Distinguishes between strict intentionalism and moderate intentionalism. Both are often seen as a means for reducing vagueness in legal language. However, counterfactual intentions are needed to resolve certain problems. First, in combining actual intentions, e.g. in a legislature, where different combinations may result in different legislation. Second, it is needed to resolve conflicts between intentions, particularly between different levels of abstraction. Third, reducing vagueness, which will be necessary even with enactment intentions. Fourth, there may be no determinate intention that would even, in principle, resolve a borderline case - e.g. when intentions are conflated. [For discussion of application and enactment intentions, see Goldsworthy, "Originalism in Constitutional Interpretation," Federal Law Review 25: 1.] Lastly, counterfactuals may be necessary to distinguish between application and enactment intentions. Lewis on counterfactuals: "For Lewis and Stalnaker, the key idea in the explication of truth conditions of counterfactuals is that of 'comparative overall similarity' of possible worlds. A counterfactual is true if and only if in the closest, most similar world to the actual in which the antecedent of the conditional is true, the consequent of the conditional is also true." Thus, there may be a determinate relevant world for some cases - i.e. there may be a counterfactual that determines the answer to a counterfactual question. This, however, will not always be the case. For example, counterfactuals concerning Caesar being the leader of N. Korea. Here, for Lewis, where there are ties of closeness of counterfactuals, all tied CFs will be false. When considering counterfactual intentions for the sake of interpretation, some may be determinate or insensitive. Normally, however, this will not be the case. "For intentionalism to resolve the matter of whether the regulation prohibiting vehicles prohibits toy cars as well, one of these counterfactuals must be true and the other false. Imagine a possible world in which the oncsideration of the borderline case is added to the authors' mental states. It is likely that connected belief will be affected as well. For example consideration of the aim of the regulation will occur as a consequence of the consideration of whether the regulation applies to the borderline case: Is ensuring peace and quiet in the park overriding, or are there exceptions to accommodate children's games? When there are changes in a constellation of men tal states, we will have to imagine a situation in whichh the legislators' beleifs are very different from what they in fact were. This creates at least a profound epistemological problem, because, as Dworkin puts it: "[it] has the effect of sharply reducing the amount of historical evidence that is relevant to answering the counterfactual." More important, however, in some worlds in which the legislators consider the case of a child's toy car, they will treat the peace and quiet purpose as overriding, whereas in others they will treat the children's play purpose as overriding. This means that different worlds will resolve the truth-value of the counterfactuals differently." "If I am right that counterfactual reasoning is ubiquitous in intentionalism, intentionalism suffers from an extra dimension of vagueness and is therefore at a disadvantage when measured against theories that do not rely on counterfactuals.". El propósito de esta contribución es demostrar el aporte del pensarniento hobbesiano a la idea de la igualdad entre hombres y mujeres, y confrontarlo con el de su objetor B. Spinoza. En sus obras Elements of law y De Cive, Thomas Hobbes va a cuestionar la autoridad patriarcal y la desigualdad entre hombres y mujeres como expresión de una ley de la naturaleza. Por el contrario, va hablar del carácter convencional de la sujeción de las mujeres y va a exponer (...) que la familia funciona bajo la misma regla de operación de los estados, mediante el pacto. Este aparte hobbesiano parece haber reunido poca resonancia entre los filósofos posteriores, pues el único que lo tuvo en cuenta para contravenirlo fue B. Spinoza. Spinoza combatió el punto de partida hobbesiano de que la desigualdad existente entre hombres y mujeres es producto de una convención o acuerdo. Pero, tal vez a su pesar, convino que son la educación y la cultura los agentes de dicha diferenciación. This paper is aimed at showing Hobbes's contribution to the notion of quality between men and women, in opposition to Spinoza. In his books Elements of Law and De Cive, Thomas Hobbes challenges the allegation that patriarchal authoritarism and inequality between men and women are laws of nature. He assents the conventional character of women's submission, and contends tha the family functions under the same operational rule as the Stares: Agreement. This Hobbesian position seems to have had little echo arnong later philosophers, being Spinoza the only one who addressed it in order to criticize it .Spinoza opposed the Hobbesian view that inequality between men and women is the result of agreement; bur, perhaps or his own defeat, he accepted that the causes of the difference are education and culture. Abstract: In this paper I claim that Plato’s Cave is fundamentally a political, not an epistemological image, and that only by treating it as such can we appreciate correctly its relation to the images of the Sun and the Line. On the basis of textual evidence, I question the two main assumptions that support (in my view, mistakenly) the effort to find an epistemological parallel between the Cave and the Line: first, that the prisoners represent humankind in general, and, second, (...) that the cave itself represents the visible world of ordinary experience while the world outside the cave represents the realm of the Forms. Disrupting these assumptions opens up a reading that highlights the cultural and political themes at play in this famous allegory and allows us to make better sense of it. -/- Keywords: Plato, Cave, Politics, Culture -/- Resumen: En este ensayo sostengo que la Caverna de Platón es fundamentalmente una alegoría política, no epistemológica, y que solo tratándola como tal, podremos apreciar correctamente la relación que guarda con las imágenes del Sol y de la Línea. Sobre la base de evidencia textual, pongo en duda las dos hipótesis principales sobres las que se funda (a mi parecer, equivocadamente) el esfuerzo por encontrar un paralelo epistemológico entre la Caverna y la Línea: la primera, que los prisioneros representan a la humanidad en general, y la segunda, que la propia caverna representa el mundo visible de la experiencia corriente, mientras que el mundo fuera de la caverna representa el reino de las Ideas. O presente trabalho tem por objeto o retorno a Hegel proposto por Axel Honneth, em O direito da liberdade. Ante as concepções de liberdade negativa e reflexiva - segundo ele, “conceitos de liberdade individual que não levam adequadamente em conta a sua dependência em relação à mediação objetiva” -, Honneth se preocupa em oferecer uma compreensão alternativa, mais larga, de liberdade, que ele nomeia, atribuindo-a diretamente a Hegel, de liberdade social. Tal liberdade, ao contrário da liberdade meramente jurídica ou moral, (...) permitiria que se leve em conta o papel exercido pelas instituições e práticas normativas para a sua realização, reconhecendo-as como sua própria condição. Entretanto, apesar da valorização que é feita assim por Honneth às instituições, o autor é criticado por apresentar uma concepção das mesmas que seria demasiado unilateral. O mesmo ocorre com sua definição de “liberdade social”, a qual remeteria, segundo os críticos, a uma liberdade meramente individual, aquém da significação que lhe seria dada por Hegel. A análise da tese hegeliana acerca de uma eticidade imanente à esfera do mercado e às suas práticas, adotada também por Honneth, nos possibilitará avaliar não só os aspectos que os aproximam ou os separam, mas também a pertinência das críticas dirigidas a Honneth. The aim of the paper is to investigate the return to Hegel proposed by Axel Honneth in his work Freedom’s right. Honneth rejects an approach that conceives of freedom only as negative or reflexive. Hence, he seeks to provide an alternative concept, which he assigns to Hegel using the term “social freedom”. This concept of freedom, in opposite to the merely legal or moral one, should enable the recognition of the role played by the institutions as a condition in the process of its realization. However, despite the importance he gives to the institutions, Honneth is criticized for presenting an apparently too partial comprehension of them. The same happens to his definition of “social freedom”, which, according to the critics, would consist in a merely individualistic conception of freedom, falling short of Hegel’s understanding of this concept. An analysis of Hegel’s thesis about an ethicity that would be immanent to the market sphere, also adopted by Honneth, will allow us to evaluate not just the connecting points or the divergences existing between them, but also the relevance of the criticism directed at Honneth. In this paper I defend the view that Berkeley endorses a spirit-idea dualism, and I explain what this dualism amounts to. Central to the discussion is Berkeley's claim that spirits and ideas are "entirely distinct." Taken as a Cartesian real distinction, the "entirely distinct" claim seems to be at odds with Berkeley's view that spirits are substances that support ideas by perceiving them. This has led commentators to deflate Berkeley's notion of "entire distinction" by reading it as analogous to the (...) categorical distinction between substance and accident. I argue that rather than taking Berkeley's notion of "entire distinction" in either of these ways, it ought to be understood as insisting upon a radical dissimilitude between spirits and ideas. This dissimilitude requires that ideas cannot be viewed as analogous to modes or accidents which inhere in a substance. Moreover, spirits and ideas cannot be understood in terms of a single, gradated scale of reality. Instead, for Berkeley spirits and ideas occupy two entirely different scales of reality and consequently the very term 'thing' applies to them in different senses. In this way, Berkeley endorses a severe dualism that occurs at the highest level of his ontology. En este trabajo defiendo que Berkeley sostiene un dualismo espíritu-idea y explico qué significa tal dualismo. Es central en la discusión la afirmación de Berkeley que los espíritus y las ideas son "totalmente distintos". Considerada como una distinción real cartesiana, la tesis "totalmente distintos" parece estar en tensión con la concepción de Berkeley de que los espíritus son sustancias que "support ideas by perceiving them". Esto ha llevado a los comentadores a disminuir la noción de Berkeley de "distinción total" leyéndola como un análogo a la distinción categorial entre sustancia y accidente. Yo argumento que en lugar de considerar a la noción de Berkeley de "distinción total"en alguno de esos modos, debe ser comprendida como insistiendo en una radical diferencia entre espíritus e ideas. Esta diferencia requiere que las ideas no se vean como análogas a modos o accidentes de la sustancia. Además espíritus e ideas no pueden ser entendidos en términos de una única escala graduada de realidad. En cambio para Berkeley espíritus e ideas ocupan dos escalas totalmente distintas de realidad y en consecuencia, el término mismo "cosa" se aplica en sentidos distintos. Trata-se de examinar neste artigo o método de exposição adotado por Rousseau para descrever, à luz da tradição, sua doutrina contratualista e, em particular, esclarecer nessa doutrina a necessidade da relação entre política e religião no problema da origem da sociedade. A referência central do presente artigo é a fenomenologia material da vida de Michel Henry (1922-2002), fenomenologia essa mediante a qual se evidencia o quanto Karl Marx (1818-1893) merece ser reconhecido como o pensador de uma subjectividade radical em processo de realização mediante uma praxis imanente dos indivíduos, anterior a toda a abstracção política, económica ou institucional Assim, para o autor do artigo, a aplicação desta fenomenologia à economia mostra até que ponto esta última, com as suas equivalências de mercado (...) e capital, não constitui nem uma realidade nem uma teoria autónomas. Por outro lado, o artigo salienta também a enorme importância que para as nossas vidas reais e concretas pode e deve ter uma verdadeira meta-genealogia do processo real da produção e do consumo, especialmente no contexto de uma mundialização cada vez mais objectivista, baseada na aliança entre a ciência e a técnica. Com efeito, o perigo da alienação não é permanente apenas no contexto de uma tal evolução, pois, segundo Michel Henry, o cienti-fismo moderno, ao evacuar a vida subjectiva dos indivíduos, constitui também meio propício para o desenvolvimento de um fascismo latente baseado na negação "metafísica" da individualidade, assim como na "morte" associada às abstracções vazias de uma economia que facilmente se dispensa do "factor humano" ao nível de uma racionalização metodológica sem limite. The central matter of this paper is the material phenomenology of life of Michel Henry (1922-2002), a phenomenology through which it becomes evident how much Karl Marx (1818-1893) deserves to be recognised as the thinker of a radical subjectivity in the process of realization through an immanent praxis of the individuals, prior to all political, economic or institutional abstraction. Therefore, to the paper's author, the application of this phenomenology to economics shows the measure in which the later, with its equivalences of market and capital, neither constitutes an autonomous reality nor an autonomous theory. On the other hand, the paper also underlines the enormous importance which, to our real and concrete lives, a true meta-genealogy of the real process of production and consumption can and should have, especially in the context of a more and more objectivistic globalization, based on the alliance between science and technology. Indeed, the danger of alienation is not only permanent in the context of such an evolution, then, according to Michel Henry, modern scientism, as much as it tends to empty the subjective life of the individuals, is also a propitious means to the development of a latent fascism based on the negation of the "metaphysics" of individuality and, also, on the "death" associated to the empty abstractions of an economics which easily discards the "human factor" at the level of a methodological rationalization without limit. RESUMO O artigo examina se há alguma incompatibilidade entre práticas de discriminação privada e as duas partes do segundo princípio da justiça de Rawls, o princípio da equitativa igualdade de oportunidades e o princípio da diferença. Argumento que a discriminação no trabalho e em outras áreas importantes para o desenvolvimento das aptidões inatas somente atenta contra o PEIO quando tem como efeito geral o de tornar substancialmente desiguais as chances de cidadãos com similares aptidões inatas e motivação exercerem determinadas ocupações. (...) Comento também algumas dificuldades para considerar vedados pelo PEIO dois casos comuns de discriminação, a discriminação baseada em qualidade de reação e a discriminação por indicadores. Em relação ao PD, defendo que a proibição à discriminação privada se relaciona ao bem primário das bases sociais do autorrespeito e está circunscrita aos casos de discriminação degradante, como tal entendida, de acordo com Hellman, aquela cujo sentido expressivo é o de negar o igual status moral das pessoas pertencentes a um certo grupo. ABSTRACT This paper investigates the incompatibility between practices of private discrimination and the two parts of Rawls' second principle of justice, the fair equality of opportunity and the difference principle. I submit that discrimination at workplace and other sectors that are crucial for the development of natural talents only violates FEO when possessing the general effect of rendering substantially unequal the occupational chances of citizens with similar innate talents and motivation. I also point to some difficulties in proscribing, according to FEO, two common instances of discrimination, reaction qualification and proxy discrimination. Regarding the DP, my main statement is that a ban on private discrimination is related to the primary good of the social bases of self-respect and is circumscribed to instances of demeaning discrimination, defined, according to Hellman, as discrimination whose expressive meaning is denying people belonging to a given group their equal moral status. In the first part, a first exploration is made on the issue of sayability and unsayability using conceptual and investigative resources taken from the phenomenological descriptions made by Husserl in Ideas I. A first and still broad result is reached, namely, that any Erlebnis, taken in its fullness and plenitude, is ineffable, and therefore, life itself, because it is only a stream of lived experiences, as it is lived at each and every mo-ment, is unsayable, ineffable. The limit of linguistic (...) expression referred to in the title is, thus, its impossibility to express a full Erlebnis. Then, linguistic expression is examined against the background of the plenitude of this life that it cannot express but from which and in which it emerges, and this inspection brings to light in a preliminary way the several horizons that encircle it.En la primera parte, se hace una primera exploración del tema de la decibilidad y la indecibilidad empleando recursos metodológicos y conceptuales tomados de las descripciones fenomenológicas hechas por Husserl en Ideas I. Con ello se alcanza un primer resultado todavía muy amplio, a saber, que toda vivencia, tomada en su integridad y plenitud, es inefable, y por tanto, la vida misma, puesto que consiste en una corriente de vivencias, tal como es vivida en todos y cada uno de sus instantes, es precisamente inefable, indecible. El límite de la expresión lingüística a que el título se refiere es, pues, su imposibilidad para expresar una vivencia plena. Luego, se examina la expresión lingüística contra el fondo de la plenitud de la vida que no puede expresar pero de la cual y en la cual emerge, y esta inspección trae a luz de manera preliminar los diversos horizontes que la circundan. Ele também aborda o problema da modalidade das leis da natureza e apresenta uma certa crítica à visão padrão da necessidade como verdade em todos os mundos possíveis, e mostra uma aplicação da sua discussão à metafísica da Física. O termo “cogito” designa de modo genérico e impreciso um argumento que Descartes propõe em diversos momentos de sua obra. De um modo geral, os comentadores, tal como o fizeram os interlocutores contemporâneos ao autor, consideram que a expressão “penso, logo existo” (cogito ergo sum), ausente das Meditações Metafísicas, resume adequadamente este argumento único e procuram esclarecê-lo ou criticá-lo, nem sempre levando em consideração as diferentes formulações que recebe e os diferentes contextos em que ocorre. Meu objetivo neste texto é (...) simplesmente analisar o quarto parágrafo da Segunda Meditação (AT VII, 24-25; IX-1,19), no qual ele supostamente apresenta este mesmo argumento sem empregar a famosa expressão. Das muitas, diversas e relevantes questões filosóficas que este argumento suscita, gostaria de me concentrar em investigar se ele pode ser reconstruído sem que seja necessário introduzir – como uma premissa não justificada – a concepção do pensamento como sendo essencialmente consciência de si e, portanto, como envolvendo - por definição, a auto-referência imediata e incorrigível do sujeito a si mesmo. Gostaria de poder mostrar que o argumento não apenas independe dessa concepção como, além disso, conduz a essa concepção; todavia, somente o primeiro passo em direção a esta interpretação será dado neste artigo. Quanto à expressão “penso, logo existo”, minha hipótese é que, embora ausente do texto, ela, de fato, resume o sentido geral da posição cartesiana. Sua ausência explica-se pelo fato de que Descartes pretende apresentar nas Meditações a versão mais completa de seu argumento e a passagem que será aqui analisada constitui, na realidade, apenas uma primeira etapa dessa versão. A análise e a reconstrução que serão propostas supõe que o argumento apresentado no parágrafo 4 deva ser compreendido, como propõe H. G. Frankfurt, como composto de quatro etapas, cujo sentido depende do contexto argumentativo mais amplo no qual estão inseridas, como observou Jean-Claude Pariente, em seu artigo sobre o cogito nas Meditações Metafísicas.
